DEFINITIONS

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the wilddogsports.co.za website (the "Site") operated by Wild Dog Sports (Pty) Ltd ("us", "we", or "our").

Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Site. You warrant that you are at least 18 years old and you are legally capable of entering into binding contracts. If you are under 18 years old, you warrant that you have obtained consent from your parent or guardian and they agree to be bound by these Terms on your behalf.

By accessing or using the Site you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Site.

Wild Dog Sports (Pty) Ltd may at any time modify any of the terms and such modification will supersede and replace any previous terms.

INTELLECTUAL PROPERTY

All the content on the site (including our logo and Wild Dog images) is the property of Wild Dog Sports (Pty) Ltd and as such is protected by both South African and international intellectual property laws.

ELECTRONIC ACCESS

You agree that all instructions, consents, orders and other communications which may originate from you or a person who had authority to act on your behalf to operate automatically (unless it is proved that such information system did not properly execute such programming) (collectively "the originator") and which are sent to us electronically and which may (as a result of interception, equipment malfunction, the distortion of communication links or any other reason whatsoever) be different from the instructions actually sent or given, or may not have been given by you at all, shall be deemed to have been given by the originator in the form actually received by us and you will be bound by such instruction with no liability of whatever nature to us in regard thereto.

You waive any rights that you may have or obtain against us, arising directly or indirectly from any loss or damage of whatsoever nature which you may suffer as a result of the fact that we acted on your instructions/orders or instructions/orders purported to emanate from you and you indemnify us against all and any claims, liabilities, losses, costs, fines, damages and expenses incurred (whether directly or indirectly) by you, arising as a result of the fact that we have acted on your instructions/orders or instructions/orders which purported to emanate from you.

WEBSITE CONTENT

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

THE ORDERING PROCESS

Once you have selected the product you wish to purchase and submitted your request on the site, a consultant will contact you to finalise your design and issue a formal quotation. An order is considered as confirmed once the order confirmation and designs have been signed off in writing (letter / fax / email) by the customer and payment has been received. The customer is obliged to accept delivery once the order is confirmed.

We reserve the right to refuse or cancel your order at any time for any reason including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

PAYMENT

Full payment will be required upon quote acceptance, before detailed designs will be provided to the customer.

STOCK PRICING AND SPECIAL OFFERS

Stock of all goods on special offer is limited. We shall take all reasonable efforts to remove the offer from the Site once stock is sold out. However, should items still be offered after stocks are sold out, we reserve the right to refuse such orders.

We will take every effort to ensure that the estimated prices displayed on this website are correct but may not be held liable if pricing reflected on the actual quote varies from the online estimations, as this may be due to design changes, supplier price updates, logos or any other factors that may influence the final quotation.

PRODUCT AVAILABILITY

We will notify you should any product be unavailable for any reason. You accept that the display of products is not necessarily a guarantee that a product is available. Although every effort will be made to source the requested product, we cannot guarantee the availability of any product. Colours as displayed on the website may vary due to your device settings and fabric selection. Should the colour/s you require be very specific, colour samples will have to be provided and approved, which may delay the delivery time.

SHIPPING

In South Africa, unless otherwise requested, delivery will be door to door via courier, using economy road freight. The applicable transport fees may vary according to distance, order size and weight and will be included in your final quotation.

Delivery times are estimates only and may vary dependent on the courier. We will make every effort to deliver orders within the delivery window but may not be held liable should this window be extended due to unavoidable circumstances. The target delivery time is only an estimate and is not confirmed or contractually binding.

REFUNDS AND RETURNS

Custom teamwear is made to order and is based on customer confirmation of all order details. Refunds or returns for custom teamwear orders will not be accepted. If we fail to comply with the order confirmation or the product is faulty, we will happily exchange the product. Notification of an issue or fault with an order must be made within 48 hours of delivery. The goods must be retained in their original, unused condition and the cost of any loss or subsequent damage will be the responsibility of the customer.

PRIVACY

Please refer to the privacy policy which refers to the use of all personal information obtained through the Site.

WARRANTIES, DISCLAIMERS AND LIMITATION OF LIABILITY

Your use of the Site is at your sole risk. The content is provided without warranties or conditions of any kind either expressed or implied, including but not limited to implied warranties and conditions of merchant ability, fitness for a particular purpose or non-infringement.

As a condition of your access to and use of the Site, you agree to indemnify us and our successors and assignees for all damages, costs, expenses and other liabilities, including but not limited to legal fees and expenses, relating to any claim arising out of or related to your access to and use of the Site or your breach of these Terms and any applicable law or the rights of another person or party.

In no event shall we be liable for any indirect, punitive, special, incidental or consequential damage (including loss of business, revenue, profits, use, privacy, data, goodwill or other economic advantage) however it arises, whether for breach of contract or in tort, even if it has been previously advised of the possibility of such damage.

In no event shall we be liable for any claims by a third party in tort or contract, including, but not limited, to any misleading statements made and/or incorporated into any Content provided by third parties, such as manufacturers and wholesalers, and users of the Service. It is your sole responsibility to ensure the accuracy of the data inputted. You have sole responsibility for adequate security protection and backup of data and/or equipment used in connection with your usage of the Service and will not make a claim against us for lost data, re-run time, inaccurate instruction, work delays or lost profits resulting from the use of the Service.

Without limiting the foregoing, in no event will our aggregate liability to you exceed, in total, the amounts paid by you to us.

We are not liable for the consequences of any interruptions or error in the Service.

We may in our sole discretion at any time suspend or terminate the operation of this site without prior notice to you and without the need to give you reasons for such termination.
